California law holds commercial drivers to a higher standard than other drivers in drunk driving cases. You can be convicted of DUI for driving a commercial vehicle with a BAC of 0.04% or higher − half the limit for noncommercial drivers. If that happens, you could lose your license to drive a commercial vehicle for at least a year and possibly longer, as well as face substantial fines. And if the vehicle you were driving was transporting hazardous materials or other toxic substances, the possible fines and penalties increase tremendously.
A driving-under-the-influence (DUI) conviction for driving a private vehicle also puts your commercial license at risk. A first-offense conviction can result in a suspension of your CDL for a minimum of one year in California. If certain conditions are met, you may be DMV-eligible for a restricted Class A license after 30 days. The problem is if your timing is off you may have to do the 30 days again and re-enroll in DUI school again. My office will see to it that you avoid this common pitfall.
